Grandparents of Florida children have precious few rights under Florida law.
Florida courts may order visitation with a grandparent only if the court finds that it is in the grandchild's best interest when the child was born out of wedlock or the child's parents are divorced or have abandoned the grandchild.
The 2015 session of the Florida legislature saw popular bills in both the House and the Senate would expanded grandparent rights. At this writing no bill has been signed by the Governor to become law. The House version would authorize grandparent of minor child to petition court for visitation, invoke the Uniform Child Custody Jurisdiction & Enforcement Act for determination of which state has jurisdiction, and specify conditions under which court may terminate grandparent visitation.
